When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password and for all activities that occur under your account. You agree not to disclose your password to any third party.

3. Content and Conduct

Our Service allows you to learn Japanese through various interactive features including island building, vocabulary learning, conjugation training, and kana practice. You are responsible for all activities that occur under your account and all content you create or share.

You agree not to engage in any of the following prohibited activities:

• Copying or distributing any part of the Service without authorization
• Using the Service for any unlawful purpose or to violate any laws
• Attempting to interfere with or compromise the system integrity or security
• Impersonating any person or entity, or falsely stating your affiliation

4. Disclaimer and Learning Outcomes

Nihondex is a self-study platform that provides tools and resources for learning Japanese. However, we make no guarantees or warranties regarding:

• The effectiveness of our learning methods for any individual user
• The speed or level of Japanese language proficiency you may achieve
• The accuracy of the content
• The suitability of our content for any specific purpose or goal

Your success in learning Japanese depends on various factors beyond our control, including but not limited to:

• Your dedication and time commitment to studying
• Your previous experience with language learning
• Your learning style and pace
• Your practice outside of our platform

By using our Service, you acknowledge that Nihondex is a supplementary tool for Japanese language learning and not a substitute for formal education or professional language instruction. We strongly recommend combining our platform with other learning methods and resources for optimal results.

5. Subscriptions and Payments

Some aspects of the Service are provided for a fee. You agree to pay all fees in accordance with the pricing and payment terms presented to you for the Service.

Subscription Plans

We offer the following subscription plans:

• Monthly Premium: Recurring monthly payment with full access to premium features
• Yearly Premium: Annual payment with full access to premium features at a discounted rate
• Lifetime Access: One-time payment for permanent access to premium features for the duration of service operation

Service Duration and Discontinuation

While we are committed to providing long-term service, we reserve the right to discontinue the Service at our discretion. In such event:

• We will provide at least 30 days notice before any service discontinuation
• Monthly and yearly subscribers will not be charged for any period after the service ends
• Lifetime access holders acknowledge that their access is valid only for the duration of service operation
• No refunds will be issued for any subscription type, including Lifetime access, in the event of service discontinuation

Refunds and Cancellations

Monthly/Yearly Subscriptions: You can cancel your subscription at any time through your account settings. Access continues until the end of your current billing period. Refunds are available within 7 days of subscription start. No partial refunds are provided for unused portions of a billing period.

Lifetime Access: This is a one-time purchase with no recurring charges. A full refund is available within 30 days of purchase. After this period, no refunds will be provided for any reason, including but not limited to dissatisfaction with learning progress or outcomes, or service discontinuation.

To request a refund, contact our support team at [email protected] with your account details and reason for the refund. All refund requests will be processed within 5 business days.

6. Limitations of Liability

To the maximum extent permitted by law, in no event shall Nihondex, its directors, employees, partners, agents, suppliers, or affiliates be liable for any of the following:

• Direct, indirect, incidental, special, consequential, or exemplary damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Inability to access or use the service or any part of it
• Any conduct or content of any third party on the service
• Unauthorized access, use, or alteration of your transmissions or content
• Errors, mistakes, or inaccuracies in content
• Personal injury or property damage related to your use of the service
• Bugs, viruses, trojan horses, or the like that may be transmitted through the service

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, and even if we have been advised of the possibility of such damage.

In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not permitted, our liability shall be limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless Nihondex and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your content caused damage to a third party
• Any decisions or actions taken based on the information provided through our Service

This defense and indemnification obligation will survive these Terms and your use of the Service.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

You agree to submit to the personal and exclusive jurisdiction of the courts located in France for the resolution of any disputes.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

Accounts that remain inactive for more than 24 months may be removed from our system to protect your personal information.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
